Royal Decree 893/2024 of September 10, which regulates health and safety at work in the field of domestic service, entered into force on September 12, 2024. This regulation represents a substantial step forward in protecting the labor and preventive rights of domestic workers.
However, the Fifth Final Provision, in connection with the First Additional Provision, establishes a six-month period from the availability of a digital tool designed to support employers, for the effective enforceability of the obligations set out in Articles 3, 4, and 5 of the Royal Decree.
This tool, called Prevención10.es, was developed by the National Institute for Safety and Health at Work (INSST) and made available to the public on May 14, 2025. From that date, the six-month period begins to run, meaning that the obligations established in the Royal Decree will become enforceable as of November 14, 2025.
I. Employer obligations in the domestic household
Once these provisions become enforceable, the employer’s home is legally defined as a workplace subject to specific occupational risk prevention regulations. Consequently, the employer must comply with the obligations set out in Articles 3, 4, and 5 of the Royal Decree, specifically:

Conduct an initial risk assessment, taking into account the activity and characteristics of the employee.

If risks are identified, implement written preventive measures and provide a copy to the worker.

Provide suitable work equipment and ensure its safe use.
In addition, the employer must:

Inform the worker about existing risks and applicable protection measures, once the Spanish Public Employment Service issues the Resolution launching the training activities on occupational risk prevention.

Ensure health surveillance, including the possibility of carrying out appropriate medical examinations within the framework established by health legislation, once the relevant regulatory provisions on medical examinations under the National Health System are implemented.
