Bankruptcy. Restructuring and Insolvencies

It is one of the main areas of legal practice of Bufete Marroquín, having a special recognition, as two of the Firm’s partners have been highlighted by the renowned Chambers Europe and Best Lawyers Guides in recent years.

We stands out for our extensive experience in advising both companies and individuals in crisis situations and creditors affected by insolvency.

Bufete Marroquín has successfully participated in the restructuring of the financial debt of important business groups in Spain, in addition to advising small and medium-sized companies in the achievement of conventional pre-bankruptcy solutions, applying early warning mechanisms of insolvency in order to facilitate continuity of activity and heritage conservation. Likewise, regarding the insolvency of natural persons, we accompany our clients in the bankruptcy proceeding as well as request for the benefit of exoneration of the unsatisfied liabilities (BEPI).

The Firm has also accompanied companies and individuals such as Insolvency Receivers appointed by courts in numerous national and international bankruptcies, facilitating agreement solutions or advising companies and multinationals in the acquisition of production units as a priority solution to bankruptcy settlement.

Advisory services on restructuring and insolvency focus on the diagnosis and analysis of the business crisis; advice on prevention measures (including pre-insolvency) and viability plans; in restructuring or refinancing of indebtedness with public organizations, financial entities and suppliers, promoting solutions outside the insolvency frame; advice on organizational restructuring measures of the company, especially in the application of labor measures (collective files of termination or suspension, modification of working conditions); direction and advice in the execution of bankruptcy proceedings, from the perspective of the bankrupt debtor or the creditor (in this case, seeking the recovery of its credit), through all the sections of the Bankruptcy proceedings; legal direction on litigation in which the responsibility of the directors is claimed; and advice on the purchase of assets (production units) and doubtful loans, with review or due diligence processes.
