{"id":5269,"date":"2026-10-06T11:51:23","date_gmt":"2026-10-06T09:51:23","guid":{"rendered":"https:\/\/marroquinabogados.com\/?p=5269"},"modified":"2026-10-06T12:17:06","modified_gmt":"2026-10-06T10:17:06","slug":"asbestos-certificate-mandatory-for-sales-and-leases-of-real-property-in-catalonia-as-from-3-october-2026","status":"publish","type":"post","link":"https:\/\/marroquinabogados.com\/en\/asbestos-certificate-mandatory-for-sales-and-leases-of-real-property-in-catalonia-as-from-3-october-2026\/","title":{"rendered":"Asbestos certificate mandatory for sales and leases of real property in catalonia as from 3 october 2026"},"content":{"rendered":"<p>As from 3 October 2026, <strong>any person who sells or leases real property located in Catalonia must deliver to the purchaser or lessee a certificate of the presence or absence of asbestos<\/strong>. This obligation arises under Catalan Act 8\/2026, of 2 July, on the Eradication of Asbestos (Llei 8\/2026, del 2 de juliol, de l&#8217;erradicaci\u00f3 de l&#8217;amiant), published in the Official Journal of the Government of Catalonia (DOGC) on 3 July 2026 and in force three months after its publication (Seventh Final Provision).<\/p>\n<p><strong>Nature of the certificate and when it must be delivered<\/strong><\/p>\n<p>Article 21 of the Act defines the certificate as the specific document reporting on the presence or absence of asbestos in a property at the time of its issue. It must be delivered upon the sale or lease of a property, without prejudice to verification of the data recorded in the Catalan Register of Asbestos-Containing Materials (Cens catal\u00e0 de materials que contenen amiant).<\/p>\n<p>The obligation <strong>is not confined to dwellings<\/strong>. Article 5(d) recognises the right to obtain the certificate upon acquiring a property or leasing a dwelling or other real property. Accordingly, it also extends to <strong>commercial premises, offices and industrial buildings<\/strong>.<\/p>\n<p><strong>An obligation in force but pending implementing regulations<\/strong><\/p>\n<p>The Act does not specify who is to issue the certificate or the form it must take. Article 21(3) refers the determination of its characteristics and of the competence to issue it to implementing regulations. As at the date of this article, no such regulations have been adopted.<\/p>\n<p>To avoid a legal vacuum, the same provision lays down minimum transitional content. Pending the adoption of the regulations, the certificate must evidence, as a minimum:<\/p>\n<ul>\n<li>the presence or absence of <strong>visible<\/strong> asbestos;<\/li>\n<li>the state of preservation of any asbestos-containing materials; and<\/li>\n<li>the risk such materials may pose to persons.<\/li>\n<\/ul>\n<p><strong>Interim solution adopted by the Catalan Waste Agency<\/strong><\/p>\n<p>The Catalan Waste Agency (Ag\u00e8ncia de Residus de Catalunya, ARC) has published a <a href=\"https:\/\/residus.gencat.cat\/ca\/ambits_dactuacio\/tipus_de_residu\/amiant\/model_certificat\"><strong>basic model certificate of the presence or absence of visible asbestos<\/strong><\/a> for use until the regulations are adopted. According to the ARC, the certificate may be issued, within the scope of their respective professional competences, by the professionals referred to in Spanish Act 38\/1999, of 5 November, on Building Regulation (Ley de Ordenaci\u00f3n de la Edificaci\u00f3n), <strong>namely architects, building engineers (arquitectos t\u00e9cnicos), engineers and technical engineers.<\/strong><\/p>\n<p>The ARC further sets out two criteria:<\/p>\n<ul>\n<li>Where an individual unit within a building (such as a dwelling or an office) is transferred or leased, the certificate shall relate to that unit only.<\/li>\n<li>The certificate is required in respect of properties built before 2002.<\/li>\n<\/ul>\n<p>This cut-off date reflects the nationwide ban on asbestos. The <a href=\"https:\/\/www.boe.es\/eli\/es\/o\/2001\/12\/07\/(1)\">Ministerial Order of 7 December 2001<\/a>, which transposed Directive 1999\/77\/EC and amended Annex I to Royal Decree 1406\/1989, prohibited the placing on the market and use of all varieties of asbestos, with effect from 14 June 2002. Materials already installed could remain in place until their removal or the end of their service life; consequently, the risk is concentrated in buildings pre-dating that date.<\/p>\n<p>It should be stressed that <strong>this latter criterion is an interpretation by the ARC<\/strong>: Article 21 of the Act does not limit the obligation by reference to the date of construction. For properties built after 2002, we recommend a case-by-case assessment.<\/p>\n<p><strong>Penalties: the amount is fixed; the sanctioning authority is not<\/strong><\/p>\n<p>The Act already classifies failure to deliver the certificate as a <strong>minor infringement<\/strong> (Article 53(c)), <strong>punishable by a fine of EUR 100 to EUR 3,000<\/strong> (Article 54(1)(a)).<\/p>\n<p>What remains outstanding is the designation of the competent authorities. Article 49(1) vests the power to impose penalties in the Government of Catalonia, the bodies competent by subject matter and the municipal bodies, as determined by regulations. Until then, the effective enforcement of the penalty regime remains uncertain; the obligation itself, however, is fully enforceable.<\/p>\n<p><strong>Related obligations and practical recommendations<\/strong><\/p>\n<p>The Act imposes further related duties:<\/p>\n<ul>\n<li>Operators selling or leasing dwellings to consumers must disclose the presence or absence of asbestos <strong>in any offer and advertising<\/strong>, in accordance with the certificate (Article 10(h)).<\/li>\n<li><strong>Property managers<\/strong> (administradores de fincas) must ensure that owners deliver the certificate and assist them in obtaining it (Article 12(1)(b)).<\/li>\n<li>Upon registration of any transfer of ownership for consideration, the certificate of presence of asbestos <strong>must be entered in the Land Registry<\/strong> (Seventh Additional Provision).<\/li>\n<\/ul>\n<p><strong>Sources<\/strong><\/p>\n<ul>\n<li><a
