EL TRIBUNAL DE JUSTICIA DE LA UNI\u00d3N EUROPEA (TSJU) SE PRONUNCIA SOBRE EL DERECHO A LA PRESTACI\u00d3N POR DESEMPLEO DE LOS EMPLEADOS DEL HOGAR<\/strong><\/p>\n

 <\/p>\n

Son varios los medios de comunicaci\u00f3n que se han hecho eco en estos \u00faltimos d\u00edas de la sentencia <\/a><\/span><\/strong>del Tribunal de Justicia de la Uni\u00f3n Europea (TJUE) que resuelve sobre la cuesti\u00f3n prejudicial planteada por el Juzgado de lo Contencioso-Administrativo n.\u00ba 2 de Vigo acerca del derecho de los empleados del hogar a percibir una prestaci\u00f3n por desempleo.<\/p>\n

En particular, el referido Juzgado se planteaba si el art. 251 d) de la Ley General de la Seguridad Social que establece que \u201cla acci\u00f3n protectora del Sistema Especial para Empleados de\u00a0Hogar\u00a0no comprender\u00e1 la correspondiente al\u00a0desempleo<\/em>\u201d es contrario al \u00a0art\u00edculo 4.1 de la Directiva 79\/7, sobre igualdad de trato que impide toda discriminaci\u00f3n por raz\u00f3n de sexo, ya sea directa o indirectamente, en la obligaci\u00f3n de contribuir a las cotizaciones sociales.<\/p>\n

Pues bien, planteada dicha cuesti\u00f3n prejudicial, el TJUE concluye que \u201cel referido art. 4.1. de la Directiva 79\/7\/CEE del Consejo debe interpretarse en el sentido de que se opone a una disposici\u00f3n nacional que excluye las prestaciones por desempleo de las prestaciones de seguridad social concedidas a los empleados de hogar por un r\u00e9gimen legal de seguridad social, en la medida en que dicha disposici\u00f3n sit\u00fae a las trabajadoras en desventaja particular con respecto a los trabajadores y no est\u00e9 justificada por factores objetivos y ajenos a cualquier discriminaci\u00f3n por raz\u00f3n de sexo<\/em>\u201d.<\/p>\n

Si bien habr\u00e1 que ver que es lo que el Juez de Vigo resuelve tras la contestaci\u00f3n dada por el TJUE, lo que est\u00e1 claro es que esta sentencia abre las puertas a que el Gobierno, de una vez por todas, inicie un proceso legislativo para incluir a los m\u00e1s de 400.000 empleados del hogar de nuestro pa\u00eds en la protecci\u00f3n por desempleo.<\/p>\n
